They worked as machine operators assigned at Lemon Square, a food manufacturing company, under the agency Reina Manpower Service Cooperative.
The said workers alleged illegal dismissal and sought the assistance of the Branch for their reinstatement and payment of back wages.
During the initial conference conducted by Conciliator-Mediator Rowena M. Gutierrez, the workers explained that due to an incident resulting to the malfunctioning of the machine they were operating, they were verbally placed under preventive suspension on September 3, 2021.
The representative of the Reina Manpower Service Cooperative clarified that the decision regarding the incident issued by the Company last September 30, 2021 was an accident and not the fault of the workers, thus, they may return to work any time; monetary claim for back wages on the unworked days remains pending.
After a thorough discussion on October 6, 2021, the parties were able to settle the RFA.
Management agreed to pay the back wages of the two affected workers in the amount of Php13,500.31 each, covering the period September 3-29, 2021 and will be given on October 7, 2021.
Likewise, the two affected workers will report back to work on October 11, 2021.
The settlement of the RFA was facilitated by Conciliator-Mediator Othello B. Tongio, Jr.
Reina Manpower Service Cooperative is a manpower agency located at Pangulo Road, Obando, Bulacan.
The complainants, Messrs. Elemento and Abelo are both residents of Brgy. Bancal, Meycauayan, Bulacan.
